Tterms and conditions

The Torii & Ko loyalty program is a promotional loyalty program through which the brand offers incentives to its customers in the form of points, tiers, and benefits, as an encouragement for their preference, repeat purchases, and engagement with the brand. The points, tiers, and benefits granted within the program do not constitute money, an acquired right, or a financial instrument. They are commercial incentives subject to the terms and conditions established herein.

Membership in the Torii & Ko loyalty program is free and available to individuals over 16 years of age residing in Colombia. Only one account per person is allowed. Torii & Ko reserves the right to cancel duplicate accounts, accounts created with false information, or accounts used improperly. By enrolling in the loyalty program, you declare that you have the legal age and capacity to accept these terms and conditions. If you are a minor, your parent or legal guardian must review and accept these terms on your behalf.

Torii & Ko's loyalty program may have different membership tiers, based on the points accumulated by the customer. The tiers, names, point ranges, and specific benefits will be published on the website or through the brand's official channels. Each tier will be valid for 365 days from the date it is reached. If the user moves up to a higher tier during that period, the validity counter will automatically reset from the date of the new upgrade. If, after 365 days, the user does not reach a higher tier, their tier will be automatically recalculated based on the number of points accumulated at that time.

This means that the user does not necessarily lose their points, but their tier may remain the same, go up, or go down depending on their point balance and the current conditions of the program.

Points may be accumulated through various actions defined by Torii & Ko, such as:

• Loyalty program registration.
• Completing the user profile.
• Subscribing to the newsletter.
• Making purchases in the online store.
• Participating in special campaigns.
• Birthday celebrations, where applicable.
• Other promotional actions communicated by the brand.

Points for purchases will only be accumulated from the date of enrollment in the loyalty program.

It will not be possible to claim points for purchases made prior to registration in the program.

Torii & Ko may define, modify, or update the accumulation rules, equivalences, participating actions, and benefits associated with the program at any time.

Points may expire after 12 consecutive months of account inactivity. Any purchase, point redemption, or action expressly indicated by Torii & Ko as valid to restart the expiration counter will be understood as valid activity. Points awarded for birthdays, special bonuses, or promotional campaigns may not count as activity for expiration purposes, unless the brand expressly indicates otherwise. Torii & Ko may send automatic reminders before points expire, via the email registered by the user.

Points may also be automatically removed if the membership is canceled, suspended, or revoked for any reason.

The expiration of points in accordance with these rules does not constitute a penalty, but rather an objective condition of the promotional incentive. Consequently, the expiration of points or level adjustment will not give rise to compensation, refunds, or indemnities of any kind.

Accumulated points may be redeemed for benefits defined by Torii & Ko, such as:

• Discounts on future purchases.
• Exclusive benefits.
• Gifts or promotional products.
• Early access to new releases.
• Free shipping, when applicable.
• Experiences or special benefits communicated by the brand.

Points can only be used within the Torii & Ko loyalty program and have no cash value. Points and benefits:

• Are non-transferable.
• Cannot be sold.
• Cannot be exchanged for cash.
• Cannot be assigned to third parties.
• Are not cumulative with other discounts, promotions, or benefits, unless expressly indicated by Torii & Ko.

Point redemption will be subject to availability, purchase conditions, maximum redemption limits, and rules in effect at the time of redemption.

Torii & Ko may allow program members to redeem points for discounts on future purchases.

The equivalence between points and discount value will be informed on the website or through the brand's official channels.

Point-based discounts can only be used at the time of purchase and will have no cash value without an associated purchase. Discounts derived from the program cannot be partially or fully exchanged for cash.

Torii & Ko may offer gifts, promotional products, samples, accessories, special benefits, or exclusive experiences for loyalty program members. These benefits will be subject to availability, inventory, current campaigns, and specific conditions informed by the brand.

Gifts or exclusive benefits will not be exchangeable, returnable, or have cash value. When applicable, only one gift or special benefit may be redeemed per order, unless Torii & Ko expressly indicates otherwise.

The loyalty program may include free shipping benefits for certain membership levels or special campaigns.

Free shipping benefits will be subject to:

• User level.
• Minimum purchase value.
• Logistics coverage.
• Service availability.
• Specific campaign or benefit conditions.
• Validity of the level or promotion.

Torii & Ko may grant, modify, suspend, or revoke free shipping benefits when the user level or program conditions change.

In the event of a total cancellation, return, or refund of an order, the points earned from that purchase will be automatically removed from the user's account. In the event of a partial cancellation, return, or refund, points will be deducted proportionally based on the refunded amount relative to the total order value.

If the user redeemed points or benefits on a fully canceled order, the points may be automatically re-credited, provided the system and program conditions allow it. For partial refunds, redeemed points may be returned proportionally. Gifts, exclusive benefits, or promotional products redeemed within the program are not exchangeable, returnable, or redeemable for cash.

Points are accumulated only from the user's enrollment date in the Torii & Ko loyalty program.

It is not possible to claim points for purchases made before registering for the program.

Torii & Ko reserves the right to suspend or cancel the membership of any user who, in its reasonable discretion, abuses, manipulates, or fraudulently uses the program.

This includes, but is not limited to:

• Creating multiple accounts to improperly accumulate or redeem points.
• Using false information.
• Manipulating purchases, returns, or benefits.
• Reselling gifts, benefits, or promotional products from the program.
• Using automated tools, bots, or fraudulent mechanisms.
• Engaging in any conduct that affects the interests of Torii & Ko or other users.

In the event of membership cancellation due to fraud or misuse, all accumulated points will be automatically deleted and pending orders may be canceled or reviewed.

Torii & Ko reserves the right, at its sole discretion, to modify, suspend, or terminate the loyalty program at any time.

This includes changes to:

• Benefits.
• Point values.
• Equivalencies.
• Tiers.
• Accumulation thresholds.
• Redemption rules.
• Point validity.
• Free shipping conditions.
• Exclusive gifts or benefits.

Any changes will be published on the website or communicated through the brand's official channels.

The user's continued participation in the program after the publication of changes constitutes acceptance of the updated terms. Participation in the program generates only the expectations derived from the current and expressly informed conditions. In no case may advertising, promotional, or informational content related to the program be interpreted as a promise of indefinite permanence of points, tiers, or benefits.

By enrolling in the Torii & Ko loyalty program, you agree to receive communications related to the program, benefits, point activity, promotions, launches, news, and brand marketing materials.

You can unsubscribe from marketing communications at any time by following the instructions included in the emails or by writing to:

Unsubscribing from marketing communications will not necessarily affect your membership or your ability to participate in the program, unless such communications are necessary for its administration.

By enrolling in the Torii & Ko loyalty program, you authorize the collection and use of your personal information in accordance with the brand's Privacy and Personal Data Protection Policy, and in compliance with Law 1581 of 2012 and other applicable regulations in Colombia.

Your information will be used for:

• Managing your membership.
• Registering and updating points.
• Managing benefits.
• Processing orders.
• Communicating program updates.
• Sending information related to your benefits.
• Complying with legal, commercial, and administrative obligations.

Torii & Ko will not sell your personal information to third parties. Information may only be shared with suppliers or partners necessary to operate the program, process orders, manage benefits, or fulfill legal obligations.

To the maximum extent permitted by applicable law, Torii & Ko will not be liable for damages arising from user participation in the loyalty program, including damages related to modifications, suspension, or termination of the program.

This limitation applies to all types of damages, including direct, indirect, incidental, punitive, or consequential damages, always within the limits permitted by current Colombian legislation.

These terms and conditions are governed by the laws of the Republic of Colombia.

Any dispute arising from or related to the Torii & Ko loyalty program shall be resolved before the competent courts of Colombia, in accordance with current regulations, including consumer protection provisions established in Law 1480 of 2011.
